Terms and Conditions (T&C) Wiesenquell Apartment Feldberg

1. Contracting Parties
The rental agreement is concluded between: Manfred Jäger & Anja Jäger GbR, operating as Wiesenquell Apartment (hereinafter referred to as the “Host”) and the guest.

2. Booking / Booking Confirmation
Booking requests must be made via our website www.wiesenquell-apartment.de or by email at info@wiesenquell-apartment.de . Requests via other communication channels (e.g. social media) cannot be considered. If the apartment is available for your requested period, you will receive a written confirmation and invoice by email. The booking becomes binding upon receipt of the booking confirmation and payment of the deposit (see Section 3).

3. Payment Terms
The booking becomes binding upon receipt of the deposit. A deposit of 20% of the total rental price is due within 7 days after receiving the booking documents. The remaining balance is due 30 days prior to arrival. If payment deadlines are not met, the Host reserves the right to withdraw from the contract. Non-payment is considered a cancellation and entitles the Host to re-let the property. No additional charges are applied for water, parking, or waste disposal.

4. Arrival and Departure
The apartment is available from 3:00 PM on the day of arrival. Information regarding the key code will be provided via email prior to arrival. Claims for damages are excluded unless caused by intentional or grossly negligent behavior. On the day of departure, the apartment must be vacated by 10:00 AM. Late departure must be agreed upon in advance. Unauthorized late departures may be charged. If the guest does not arrive by 10:00 PM on the day of arrival without prior notice, the contract may be considered terminated after 48 hours. The Host may then freely dispose of the apartment. No (partial) refund will be given in case of early departure. The apartment must be left in a clean condition upon departure. Dishes must be cleaned and stored, trash disposed of, and the refrigerator emptied. Additional cleaning costs may be charged if the apartment is not left in proper condition.

5. The Apartment
The apartment is handed over in a clean and proper condition with complete inventory. Any defects must be reported to the Host immediately. The guest is liable for damages caused to the property or its contents (e.g. broken dishes, damage to furniture or floors), including lost keys. All inventory must be treated with care and remain within the apartment. Rearranging furniture, especially beds, is not permitted. The guest is also liable for the actions of accompanying persons. Damages caused by force majeure are excluded. In case of misuse (e.g. subletting, overcrowding, disturbance), the contract may be terminated without notice. Already made payments will be handled according to the cancellation policy.

6. Pets
Pets are not allowed. If pets are brought without prior consent, a cleaning fee of up to €150 may be charged.

7. Stay
The apartment may only be used by the number of guests specified in the booking. If additional persons stay in the apartment, an extra charge of €50 per night per person may apply. The Host reserves the right to terminate the contract without notice in such cases. Subletting or transferring the apartment to third parties is not permitted. By making a payment, the guest agrees to these terms and the house rules. In case of violations, the Host may terminate the contract immediately. Refunds will only be granted in accordance with the cancellation policy.

8. Cancellation
Cancellations must be made in writing. The following cancellation conditions apply: up to 14 days before arrival: free of charge from 13 days before arrival: 50% of the total price from 3 days before arrival or in case of no-show: 100% of the total price The relevant date is the time when the cancellation is received by the Host. We always strive to find a fair and accommodating solution.

9. Cancellation by the Host
In the event of cancellation by the Host due to force majeure or other unforeseeable circumstances beyond the Host’s control (e.g. accident or illness), liability is limited to the refund of payments made. No claims for damages (e.g. travel or accommodation costs) can be made.

10. Liability of the Host
The Host is responsible for providing the apartment in proper condition. Liability for interruptions in water, electricity, or events caused by force majeure is excluded. Liability is limited to intent and gross negligence.

11. Use of Wi-Fi
The apartment provides internet access via Wi-Fi. Guests are permitted to use the Wi-Fi during their stay. The guest may not grant access to third parties. The Host does not guarantee availability, suitability, or reliability of the internet connection. The Host reserves the right to restrict or block access in case of misuse.
11.1 Access Data Wi-Fi access is secured with login credentials. These credentials must not be shared with third parties. Any third-party use requires prior written consent. The guest must keep access data confidential. The Host reserves the right to change access data at any time.
 11.2 Risks of Wi-Fi Usage Wi-Fi only provides internet access. No virus protection or firewall is guaranteed. Data transmission may not be encrypted and may be accessible to third parties. The use of Wi-Fi is at the guest’s own risk. The Host is not liable for damage to devices unless caused intentionally or through gross negligence.

12. House Rules and Obligations
Guests must comply with the house rules. Quiet hours: 10:00 PM – 8:00 AM. Windows and doors must be closed when leaving the apartment. Smoking is prohibited inside the apartment. Violations may result in a cleaning fee of up to €150. Smoking is only permitted on balconies or terraces. A parking space (No. 04) is available. Use of furniture and outdoor areas is at the guest’s own risk. Parents are responsible for their children. Decorations may not be installed. Guests are liable for any resulting damage. The Host has the right to enter the apartment in case of emergency. The guest’s privacy will be respected as far as possible.

13. Final Provisions German law shall apply.
